These Terms & Conditions apply to your use of the Asma Healing Art website and to purchases made through it. By placing an order, you agree to these terms.
1. About Us
This website and online shop are operated by Asma Healing Art.
Questions may be submitted through the Contact page on this website.
2. Artwork and Product Information
We take reasonable care to describe and display artworks and products accurately. However, colours and appearance may vary depending on lighting, photography, screen calibration, device settings and other factors outside our control.
Images shown on the website are for representation of the artwork or product and may not reproduce colours, texture, scale or fine detail exactly as they appear in person.
Measurements and dimensions may be approximate unless expressly stated otherwise.
3. Original Artwork
Original artworks are unique items and are normally available in a quantity of one.
Placing an item in your basket does not reserve it. Availability is subject to confirmation and successful payment.
If an original artwork becomes unavailable because of an inventory error, simultaneous purchase or another circumstance outside our reasonable control, we may cancel the order and refund any amount paid.
4. Prints
Prints may be produced or fulfilled by third-party production and fulfilment providers.
Minor differences in colour, positioning, finish, paper, material or dimensions may occur as part of normal production and are not necessarily defects.
5. Orders
An order submitted through the website constitutes an offer to purchase.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- A product is unavailable
- A price or description contains an obvious error
- Payment is not authorised
- We reasonably suspect fraud or misuse
- Delivery to the requested location is unavailable or impractical
If we cancel an order after receiving payment, the appropriate amount paid for the cancelled item will be refunded.
6. Prices and Payment
Prices are displayed in pounds sterling (GBP) unless stated otherwise.
Asma Healing Art is not currently VAT registered and does not add UK VAT to product prices.
Payment is handled by third-party payment processors. Their own terms and privacy policies may also apply.
7. Delivery
Delivery charges, availability and estimated delivery times depend on the product and destination.
Any delivery date is an estimate unless expressly agreed otherwise.
Asma Healing Art is not responsible for delays caused by events outside our reasonable control, including courier disruption, customs procedures, adverse weather, transport disruption or incorrect delivery information supplied by the customer.
8. Import Duties and International Orders
For deliveries outside the United Kingdom, the recipient may be responsible for import duties, customs charges, taxes, handling fees or other charges imposed by the destination country.
Unless expressly stated otherwise, these charges are not included in the purchase price or delivery charge and are the customer’s responsibility.
9. Returns, Cancellations and Consumer Rights
We do not offer an additional voluntary change-of-mind returns policy beyond rights that customers have under applicable law.
Nothing in these Terms & Conditions limits or excludes any statutory consumer rights that cannot legally be excluded.

10. Damage in Transit
Please inspect your order promptly after delivery and contact us as soon as reasonably possible if an item arrives damaged, faulty or materially different from its description.
We may request photographs, packaging information and other reasonable evidence so that we can investigate the issue with the delivery or fulfilment provider.
11. Intellectual Property and Artwork Copyright
Purchase of an original artwork or print transfers ownership of the physical item only.
Unless expressly agreed otherwise in writing, copyright and all other intellectual property rights in artwork, photographs, designs, text and other creative material remain with the artist or relevant rights holder.
Purchasing an artwork does not grant the buyer the right to reproduce, copy, publish, commercially exploit, distribute, create merchandise from or otherwise use the artwork’s image for commercial purposes.
12. Website Use
You must not misuse the website, attempt unauthorised access, interfere with its operation, introduce malicious software or use website content unlawfully.
We may suspend or restrict access where reasonably necessary to protect the website, our customers or our business.
13. Website Availability
We do not guarantee that the website will always be available, uninterrupted, error-free or free from technical problems.
We may change, suspend or withdraw parts of the website where reasonably necessary.
14. Limitation of Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under applicable consumer law.
Subject to the above, Asma Healing Art will not be responsible for losses that were not reasonably foreseeable when the contract was entered into, or for losses arising from circumstances outside our reasonable control.
If you are purchasing as a consumer, we are not responsible for business losses, loss of profit, loss of revenue, loss of business opportunity or other commercial losses arising from use of a product purchased for personal use.
Nothing on this website constitutes medical, therapeutic, financial, legal or other professional advice. References to art, wellbeing, healing, emotion or similar concepts describe artistic themes or intentions only and are not promises or guarantees of any particular physical, psychological or other outcome.
15. Events Outside Our Control
We will not be responsible for delay or failure to perform obligations where caused by circumstances outside our reasonable control.
16. Governing Law
These terms are governed by the laws applicable in England and Wales, subject to any mandatory consumer protections that apply to you.
17. Changes to These Terms
We may update these terms from time to time. The terms applicable to an order will normally be those made available when the order was placed.
